Philander and Thurza McCarter Sell Property in Denmark, Lewis, New York

June 14, 1856

Achsah W. Marcellus, Eliza Ann D. Gancy, and Lucy H. Rehew each purchased over eight acres of land in Denmark, Lewis, New York from Philander and Thurza McCarter of Grayson County, Virginia.

This was likely three quarters of the 32 acres Philander had purchased in Denmark, Lewis, New York in 1827. Apparently Philander still owned eight acres at based on the description in the first deed.

This Indenture made this 14th fourteenth day of December one thousand eight hundred and fifty six, Between Philander McCarty and Thurza his wife of the County of Grayson and State of Virginia of the first part and Achsah W. Marcellus of the town of Denmark, County of Lewis and state of New York of the second part.

Witnesseth that the said party of the first part for and in consideration one hundred dollars [$100] to him in hand paid by the said part of the second part doth grant, bargain, sell, and confirm unto the said party of the second part and and to her heirs and assigns forever all that certain piece or parcel of land lying and being in the town of Denmark, Lewis County, State of New York bounded as follows.

Beginning at a cedar stake on said town line and one chain 81 links East of a block ash tree on said line Marked No 27 28 at one of the corners of Lot No. 27 thence North East on the line of land owned by Philander McCarty to a stake in the highway 2 chs 83 3/4 links southwardly from the Northern Corner of said McCarty’s land on said highway, thence on said highway 2 chs 83 3/4 links to a stake, thence Southwest to a stake on said town line, thence on said town line West to the place of beginning containing Eight acres and fifteen rods of land.

Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining to have and to hold the said premises above described to the said part of the second part her heirs and assigns forever, and the said Philander McCarty and Thurza his wife of the first part for himself and Thurza his wife and his heirs doth covenant, grant, promise and agree to and with the said party of the second part, her heirs and assigns the above bargained premises against all and every person or persons, whatsoever lawfully or equitably claiming or to claim the whole or any part thereof forever to warrant and defend.

Sealed and delivered in presence of John Stone, J.P. Grayson County to wit:

Mr. James Wright and John Stone Justices of the Peace for the County aforesaid in the state of Virginia certify that Philander McCarter and Thurza his wife whose names are assigned to the writings above, bearing date on the 14 day of June 1856 [14 Jun 1856] acknowledged the same before us in our county aforesaid and the said Thurza McCarter wife of the said Philander McCarter being examined by us privately and apart from her husband having the writings fully explained to her she the said Thurza McCarter declared that she had wittingly executed the same and does not wish to retract it. Given under our hands this 15th day of November 1858.

This Indenture made this fourteenth day of June one thousand eight hundred and fifty six [14 Jun 1856]. Between Philander McCarty, Thurza his wife of the county of Grayson and State of Virginia of the first part and Eliza Ann D. Gansey of the town of Denmark, County of Lewis, and state of New York of the second part.

Marcellus to a stake in the highway, thence on said highway Southerly 2 chi 83 2/4 links, thence Southwestwardly to a stake on said town line, thence on said town line to the place of beginning. Containing Eight acres and Fifteen rods of land.

Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining to have and to hold the said premises above described to the said party of the second part her heir and assigns forever and the said Philander McCarty and Thurza his wife of the first part for himself and his heirs doth covenant, grant, promise, and agree to and with the said party of the second part her heirs and assigns the above bargained premises against all and every person or persons whatsoever lawfully or equitably claiming or to claim the whole or any part thereof forever to warrant and defend.

James Wright & John Stone Justices of the Peace for the County of Grayson in the state of Virginia certify that Philander McCarter and Thruza his wife whose names are signed to the writings above bearing date on the fourteenth day of June 1856 acknowledge the same before us in our county aforesaid and the said Thurza McCarter wife of the said Philander McCarter, being examined by us privately and apart From her husband and having the writings aforesaid fully explained to her, she the said Thruza McCarty declared that she had willingly executed the same and does not wish to retract it. Given under our hands this 15th day of November 1858.

Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining to have and to hold the said premises above described to the said part of the second part her heirs and assigns forever, and the said Philander McCarty and Thurza his wife of the first part for himself and Thurza his wife and his heirs doth covenant, grant, promise and agree to and with the said party of the second part, her heirs and assigns the above bargained premises against all and every person or persons, whatsoever lawfully or equitably claiming or to claim the whole or any part thereof forever to warrant and defend.
